
A Few Questions about the Mediator of the French Republic.
It can happen that the application of the law leads to an exceptional and sufficiently serious prejudice to a person, justifying an intervention based on the duty of solidarity.
Exceptionally , the Mediator of the French Republic may ask the government to reconsider its decision when that decision, although in accordance with a law or regulation, carries with it consequences he regards as intolerable or unfair for the person concerned.
However, no two cases are ever exactly the same. Circumstances relating to time, place and fact never exactly coincide.
- Consequently, if the decision finally taken by the government is based on the equity recommendation made by the Mediator, it will only apply to the specific case concerned.
